Yes, abortion was illegal then too, and pregnant women were denied medical treatment on religious grounds and left to die in agony like Sheila Hodgers and her daughter. What the 8th amendment did was make this immoral, religious ethos law. Forcing an embryo or zygote to term should not take precidence over the physical or mental health of a sentient woman or girl.
