    Ceann Comhairle steps in to block Anti-Evictions Bill on behalf of the government

    A Fianna Fáil spokesperson said the party had abstained from the vote because they believe the bill to be legally flawed

    The Ceann Comhairle has used his casting vote to back the government in the Dáil after voting on an opposition bill aimed at protecting renters against eviction was tied at 51 votes apiece.

    The Anti-Evictions Bill, put forward by the Anti-Austerity Alliance / People Before Profit (AAA-PBP) aimed to close “loopholes allowing legal eviction” ahead of a property sale or rent increase.

    Longstanding Dáil precedent dictates that when there is a hung vote, the Ceann Comhairle – regardless of party history – votes with the Government.

    The bill would have ensured that a tenant can remain in their home – under the same terms and conditions – when a property is sold by a landlord, bank or ‘vulture fund.’

    It also aimed to address the so-called ‘family member rule’ by ensuring that compensation “equivalent to six months’ rent” would be paid to a tenant if they are evicted on the basis that a landlord – or a member of the landlord’s family – is planning on moving in to the property.

    Finally it would have reduced the period of time before a tenancy is given ‘Part 4’ status – from six months to two months.

    Narrow defeat

    Following an initial vote the bill was defeated by 51 to 50 after Fianna Fáil abstained from the vote.

    In response, the AAA-PBP called a ‘vote through the lobbies’ – in the hope that any politician who was in the building but had failed to cast a vote might be able to swing the outcome.

      I agree with giving tenants more protection around property sale, but giving them 6 months rent for moving into a property you own is just ridiculous.

        Not ridiculous at all.It prevents unscrupulous landlords from asking tenants to leave on the basis of family member moving in.Once tenant is out, rent is increased and family member who was to move in,doesn’t.

          Surely it’s better to just ensure that the family member DOES move in? Maybe by awarding a year’s rent if, a year later, the family member hasn’t been in continuous residence?

            A tenant already living somewhere should take precedence over a landlord’s brother or uncle or aunt or first cousin or 2nd cousin twice removed IMO.

            If I owned a house somewhere that was rented out, and my child was starting in college in that city, damn right I’d want to be able to use my own property! As long as the proper procedures are followed and notice periods are given, why shouldn’t people be allowed do what they want with their own property? That doesn’t include using family as an excuse and then not following through, of course.

            Tenancy rights need to be given the upmost importance IMO. If you had a tenant in on a 25 year lease in the likes of Germany, you’d just have to make alternative arrangements for a family member.

            As it stands the notice period that needs to be given isn’t sufficient IMO. Also tenants are only protected from eviction when the landlord is selling over 10 properties and even if selling more than ten if he can prove that the property is worth more (20%) with the tenants gone, then they’re gone.

            I mean seriously, landlords want it all ways. The want to pay no taxes, they want someone else to pay their pension fund in full and they want the freedom to kick out the tenants when it suits.

            If you have policies that are turning the nation into a nation of renters, then sorry fupp your daughter and your cousin and whoever else.

        If landlords keep harping on that they provide a great service, proper security of tenure and the loopholes for getting rid of people easily, need to be addressed. Otherwise it aint such a great service is it? Gougers.

        The ceann whatis is a muppet too. I won’t vote with me conscious he says, I go with what’s expected of me. Useless weasels.

        There’s what could be defining moments in these otherwise boring muppets lives and they’ll tow the line every time.

I used to make a point of leaving a comment on those very informative posts asking where are all the whingers.
