Judge Peter Charleton
Daniel McConnell, in the Irish Examiner, writes:
The public Tribunal of Inquiry into allegations of a smear campaign against Sgt Maurice McCabe is to hold its first hearing on Monday, it has emerged.
…The Irish Examiner understands that Judge Charleton will make an opening address at the commencement of the Tribunal, which will take place in Dublin Castle.
It is understood that once underway, the tribunal will spend up to three months in private preparing for full public hearings to commence.
Judge Charleton is expected to conclude the McCabe body of work between nine months and a year.

The Charleton Tribunal you say…

“It is understood that once underway, the tribunal will spend up to three months in private preparing for full public hearings to commence.”
And?
Unless Broadsheet are implying that the endless meetings about Julie having to read and summarise various legal papers and Barry working through setting the schedule, etc need to happen in public.
People wanted a full tribunal. Tribunals take time to organize.
You’re very sensitive there Kieran, you FG’s must be under a lot of pressure at the moment.
He’s liberal fine gael, whatever the he’ll that is…
“hell”
“People” didn’t want a tribunal. That’s the fuppin point.
There are two possible routes. A commission of investigation in private, which McCabe didn’t want, and a public tribunal, which he did.
What would your solution have been?
Answers to the very simple six questions he wants answered. There is no reason, regardless of how shambolic the system is, they can not be answered without this pageantry.
People who will most likely be incriminated in this “investigation” holding their positions makes a sham of the whole thing.
“Answers to the very simple six questions he wants answered. ”
And what magical system do you envision where this just happens? Is Noirin just going to spontaneously throw in the towel and admit everything?
Bear in mind the people, in their wisdom, voted against giving the Oireachtas powers to conduct proper investigations.
Throw in the towel? How about stepping aside while the Garda Inspectorate compiles a report?
Do you know what the questions are? Do you understand how easily they could be answered within a functioning system?
What extra weight does a tribunal have in uncovering these answers?
Will you tell me the six questions, thanks
Clampers, if you scroll down here you’ll find them: https://www.broadsheet.ie/2017/02/13/private-nightmare-public-defamation-and-state-vilification/
“Do you understand how easily they could be answered within a functioning system?”
You seem to have no concept of the fact that Noirin and her cabal don’t WANT to answer these questions. So how will we get answers if we don’t have a public investigation? Like a tribunal.
What other magical “properly functioning system” of investigation do you have in mind?
So…
Why shouldn’t she be forced to step down while an investigation takes place? Seeing as it’s flawed from the outset if she holds her position?
I’m not sure you have a breeze what you are saying….
Of course she should step down. I never said she shouldn’t.
Your point was ““People” didn’t want a tribunal.” and then seemed to suggest the truth could be got to another way, but without actually saying how, or making much sense.
The Garda Inspectorate will be far more effect without her presence in An Garda Siochana. You didn’t even acknowledge their existence in all this.
Your belief in how effective a tribunal would be is genuinely confusing.
Look up for the answers he is looking for. Tell me they need a tribunal.
Have a good weekend ye scamp
Thanks Bodger
“What would your solution have been?”
The answer to that is a criminal investigation carried out by a neutral person from outside the jurisdiction. Of course something like this would never happen in Ireland because nobody in a position of power actually wants answers to these questions, so they set up these nonsensical “tribunals” which take years and never result in anyone being held accountable. Thats how Ireland operates…
“The answer to that is a criminal investigation carried out by a neutral person from outside the jurisdiction.”
To which there’s absolutely no basis or precedence in law in Ireland, and I’d wager most other countries too.
But if you want to delay the whole thing from getting started for a year while the model is considered, the structure is set, legislation is drafted, amended, funded, the search for this neutral person happens, their wage is set, criticised by the media, turned into a party political mess… etc etc, then fair play to you.
It’s more complicated than simple bar stool solutions and prognostications.
Fair point that
Have you ever heard of a criminal investigation Kieran?
So you trust the Gardai to investigate themselves?
“But if you want to delay the whole thing from getting started for a year while the model is considered, the structure is set, legislation is drafted, amended, funded, the search for this neutral person happens, their wage is set, criticised by the media, turned into a party political mess… etc etc, then fair play to you.”
It doesn’t have to be even remotely that complicated. If the goal was to get to the truth and hold people accountable for their actions then solutions would be found, but thats not the goal. The goal is to drag things out for years until people no longer know or care what the hell the issue was in the first place and then quietly release a meaningless “report” and let it die.
“It doesn’t have to be even remotely that complicated. If the goal was to get to the truth and hold people accountable for their actions then solutions would be found”
The last time the Oireachtas tried to do that, it was found to be unconstitutional. But you seem to know best.
Have a good weekend, everybody! We’ll see how this plays out on Monday :)
When was this now?!
“But you seem to know best.”
You’re a gas man Kieran, you come on with your definitive comments about the only way things can be is through a tribunal, then you finish with that BS. Just keep schilling for FG and pumping out their talking points, it’s what you do best.
When people are throwing out uninformed pie-in-the sky nonsense, then yes, I’ll stick to what’s legally possible.
Delusional.
From this thread… I get the Tribunal is the only solution offered, and that alternative suggestions above are wishy washy or pie in the sky stuff, and I’d agree.
I’d also like to see N.O’S step aside though.
That’d be necessary and/or essential, I believe
Oh yeah. She needs to go. Kicking and/or screaming.
It’s like Hannibal still prepping lunch at your local restaurant.
That’s the point, if she’s still mooching around a tribunal will always seem dubious..
Kieran, it’s fairly simple. Do you think it could be in anyway effective if she is there? I don’t see how that can be possible. It’s inherently flawed.
Looking at the questions, I don’t think it’s crazy to think the Inspectorate can answer the key ones. They would be far better equipped to do so.
Lots all hold back on the shouting at the internet.
No the point above was there’s some magical Trot solution with no basis in law where everyone unburdens themselves because neutral foreign person.
Tribunals aren’t perfect and usually a pain in the gee, but they’re the best solution to the problem.
A “Trot” solution?….Explain that. Take your time.
Your support for a tribunal is truly bizarre. Did you read the questions?
You keep asking if I’ve read the questions. Of course I have. But it doesn’t matter a damn what the questions are if you don’t have a legitimate means of asking.
So can you please come up with some rational alternative? Or do you just want to throw poo from your ignorant position? Do you have *anything* to contribute? PBP/AAA tedious whining with no interest in getting it done.
While she is still in office there is no confidence in a tribunal, the priority should be to remove her from office, if she is hanging around menacing potential witnesses a tribunal will always be viewed as a smokescreen.
You’re starting to sound a bit whiney Kieran. I understand that you’re under a lot of pressure at the moment and It must be very frustrating that not everyone can see or understand your genius but it’ll be ok. Btw, receiving support for your argument from Clampers is not a plus.
Wow…..You have deflected so much it’s incredible.
Throwing out the Trot thing then, I assume, labelling me a support of those parties with no basis whatsoever.
Getting nasty when all I’ve done is asked questions you don’t want to answer and avoid points I have made.
All this time I thought you were the happy go lucky type. Have a great week petal.
At least you have Clampers support.
Oh for crying out loud. Delusional.
You made your bed Kieran, towing the fg cult line dribbled down from Regina was never gonna win you plaudits..
I googled “delusional” Kieran, here’s what came up:
de·lu·sion·al
dəˈlo͞oZH(ə)nəl/
adjective
characterized by or holding idiosyncratic beliefs or impressions that are contradicted by reality or rational argument, typically as a symptom of mental disorder.
“hospitalization for schizophrenia and delusional paranoia”
based on or having faulty judgment; mistaken.
“see Kieran NYC”
OH MY GOSH YOU’RE SO INTELLECTUAL AND FUNNY
You have no actual ideas on the topic so you’re taking pot shots at me as usual
Oh please, reread your own comments Kieran, you’re the King of taking “pot shots”. You’ve labelled commenters as “trots, delusional” simply because they disagree with your points. We’re allowed to disagree with you, try to bear that in mind.
Give me a break. People on this thread have crapped all over the tribunal before it starts just cuz, with no alternative and no logical proposals for an alternative.
I’ve yet to hear of a different proposal that could work.
Yes because the pleb government have gone about it all wrong, by expressing confidence in her at every turn and than weakly announce a tribunal without properly considering her position or the consequences of her staying in her position for the tribunal they have thrown the whole thing into disrepute, at the moment it’s a lame duck the way it is and people have every right to crap all over it..
No basis in law? Please elaborate Legal Kieran Drunker
“People on this thread have crapped all over the tribunal before it starts just cuz”
That’s nonsense and you know it, people are disagreeing with the idea of a tribunal because they have seen it all before. These tribunals last for years and in the end have no useful outcome, this suits the establishment as they then don’t have to deal with a difficult issue. This is how “official Ireland” deals with everything, things that should take weeks or months instead take years. People spend years on hospital waiting lists, years on social housing waiting list, years waiting for justice. This is the way Ireland operates and it’s a damn shame because its the ordinary people who suffer, and the worst thing is it doesn’t have to be this way but it won’t change because the vested interests don’t give a damn.
Yeah still waiting on your alternative solution.
But no, keep inflating it with homelessness, waiting lists, etc.
Shows you’re more interested in political point scoring than actually solving the problem.
Typical PBP/Bernie Bro/Jeremy Corbyn short termist goals.
“Yeah still waiting on your alternative solution”
I gave my alternative earlier in this thread, which you already trashed. The problem is that you’re not actually interested in other peoples opinions, you have a very narrow view point and react angrily when people disagree. Open your mind a little.
So if we’re suggesting non-constitutional remedies, I think Jeremy Kyle should host the inquest on live TV. TV3 since they’re trashy enough.
Would make as much sense as your nonsense.
Also yes: I’m annoyed by the “I don’t know anything, but I think it, therefore it must be a fact” politics.
You’re such an angry person, I feel sorry for you.
Ha. I’m a naturally happy person. :)
I’m not the one bitter and twisted at some fantasy that’s never going to happen. Because I’d rather FG fail than get to the truth.
“PBP/AAA whining”..
LOL that’s fresh coming from a consummate fine gael cultist..
Never voted FG
Unlike you who supports them by not voting
Yea your so “liberal”..
Wow you guys are having a great weekend!
Raining and windy here too Kieran
