Brian O Donnell leaving Gorse Hill in Killiney with Dr Mary Patricia O’Donnell* (above). Mr O’Donnell is expected in  the High Court court this morning in another fight to remain at the home. Proceedings get under way at 11am.

    In fairness, Mrs O’Donnell looks “shook”. However, she and her husband have no one to blame but themselves. The fact that the “family home” was held in a company structure, shows that they were sophisticated investors. They gambled and lost. They have prolonged their own suffering by dragging this through the courts and coming up with a new defence every time the court rules against them. It is a big fall from grace from them, but they should NEVER have used the “family home” as security for an investment. I find it extremely hard to feel any bit of sorrow for them.

        No mother of a Blaise, a Blake, a Bruce and an Alexandra could ever be merely Patricia or Mary.

          I heard her referred to on RTE as Mary Pat the other night, which seemed a bit downmarket, but then we now know that it’s only a bog-standard house.

      If you watch the “Last Days In Vietnam” documentary it’s striking how the American ambassador refuses to contemplate evacuation even though all those around him are both urging him to do so and also making plans in spite of him.

      It’s a great study in how those in power, on the loss of it, refuse to accept reality.

    Am i the only one who is thinking “fair play to them”. I don’t like what their doing but no matter how much I owed I’d fight tooth and nail to keep my home as well. It’s Ireland after all, rich people don’t pay debts. Denis O’brien is testament to that.

      Absolutely right. Which is why their stance is to be applauded. If they succeed in driving a wedge between banking amorality and the popular right wing trash talking mediah they’ll have done the state some service.

          You’re apportioning a degree of moral superiority served with a soupcon of superciliousness. He’s just another creditor. The amount owed was approved for his loan as in any other case.
          When we see some bank guys hung out to dry in the same way we can start dishing out the medals.

      technically, they claim it’s not their home. they’re claiming a right of residence granted by their children.

        The property is owned by a company. Some of the shares in the company are owned by a trust, which was established for the benefit of the children. The property is not owned by the children and therefore the children cannot grant a right of residency to the parents.

      Rental car most likely. They don’t actually live in Ireland. They live in London, like so many Irish who went there to avoid paying their debts.

    Tbh, the glee that people are showing over this family losing their home is a bit disturbing.

      I agree wholeheartedly. Looks like the empathy chip has shorted out in so many of us. There but for the Grace etc. holds little purchase on souls.

        Nope, not empathy chip missing. Their own actions have brought this on themselves.
        They were property speculators who failed to diversify when they had the chance.
        In their bankruptcy case in London, they produced receipts for a burial plot there as Ireland was no longer home.

        Given that he has a legal background, using freeman arguments in court was laughable.
        Even after bankruptcy, they could afford to take high court and supreme court cases. Hardly indicates being broke.
        They had more options than most to deal with their problems but chose to stick their head in the sand.

        As for their New Land League friends, they are a farce. run by another property speculator who owed 3.5 million to Ulster Bank and has tried and failed to use the same freeman arguments in court.

        The O’Donells are not broke. They have resources and am sure it hurts like hell to lose on the scale that they have,

        There are many people in this country who have my deep sympathy, but not this pair.

          I’m familiar with the financial background to the story but the précis is appreciated. Schadenfreude in such cases speaks to the basest part of our nature – barely a remove from taunting ‘lunatics’ in Bedlam. I may well think they’re a bunch of greedy pricks, but losing a home can cut deep.

            you mean losing one of many homes that they listed as company assets to avoid tax. yeah, i’m sure that cuts deep.

          Justice for what exactly? Losing a bit of money? Such nonsense. This crap should not even be allowed in the High Court wasting valuable resources. If our legislators got their fingers out of their fupping holes and put in a robust bankruptcy law like in any other first world country we wouldn’t be wasting so much time and resources on these spendthrifts

      It’s not their primary residence, it’s a palatial mansion they happen to have in addition to their home which they purchased through a company to avoid paying the tax the rest of us are forced to pay. They then put it up as collateral for a business loan, which in part they now owe to you, me and everyone else – it’s not glee per se, more satisfaction that at least one wealthy gambler will be pursued for his debts while regular people are being hounded day and night.

      They claimed London as their primary residence when they were trying to get bankruptcy there. When that didn’t work, all of a sudden this is the most precious place on Earth to them and they can’t bear to part with it.

    just as a matter of interest. They owe 70+ million, but are they actually servicing the loans or is the bank trying to snatch a property as part payment for the loan?

    If they are not servicing it and trying to get a write down on their loans, then they can fup off out of there. Knock it down, built 100 apartments and allocate 80 of them for social housing.
