Last night.

On RTÉ One.

Aoife Hegarty, of RTÉ Investigates, presented a report entitled Chaos In Care.

It examined how certain vulnerable children, in the care of the State, have been harrowingly failed by the State.

It also looked at cases from the report published yesterday by the Special Rapporteur on Child Protection Dr Geoffrey Shannon which looked at the use of Section 12 of the Child Care Act 1991 by An Garda Siochana.

Section 12 of the act allows gardai to remove a child if they believe there is a serious risk to the child’s health or welfare.

In one particular case, Ms Hegarty reported:

In 2011 a young boy living in voluntary foster care – who we’ve named ‘Mark’ – told his birth mother [‘Susan’] he had been inappropriately touched by another, male foster child twice his age who was also living with the same foster family.

‘Susan’ – which is not her real name – discovered ‘Mark’ had made a similar allegation to his foster parent 5 weeks earlier but it had not been reported to the HSE.

‘Susan’ asked to have ‘Mark’ moved from the foster placement while an investigation took place – this did not happen. 

Instead a safety plan was put in place by the HSE. – this consisted of little more than an instruction to the foster parents that the two boys – who had been sharing a bedroom – “should have separate bedrooms and that the [foster] carers should supervise” them closely.

Two months later, the HSE referred ‘Mark’ for assessment by child sexual abuse experts.

The experts concluded that ‘Mark’ gave “a credible account of experiencing inappropriate sexual behaviour by his foster sibling”.

But while ‘Mark’ was assessed, it appears from case notes that his foster sibling was not.

Over the following months ‘Mark’ displayed sexualised behaviour and ‘Susan’ repeatedly reported this to the social work department.

[‘Susan’ said: “He was using his teddy bear to, pushing it up against his genitals, it was like he was imitating what had been done to him. Yeah he was saying ‘touch me you cunt’, he tried to kiss his older brother, he put his hand on his inner thigh and tried to kiss him in an adult way.”]

‘Susan’ believed her concerns were not being taken seriously by social workers so she reported the matter to the Gardaí asking them to investigate. 

In fact cases notes seen by RTÉ Investigates show that An Garda Síochána were “…quite irate…” at the management of Mark’s case by the HSE social work department – stating that the Gardaí…. “Would have a different view of child sexual abuse…” The HSE decided to leave ‘Mark’ in the foster home despite his birth mother’s concerns.

Almost 3 years later… ‘Mark’ made a second allegation – this time to a TUSLA staff member that he was being punched by the same older foster child AND by an adult son of the foster family.

The foster parents were again advised by the social work department to “increase supervision” of the boys and ‘Susan’ was informed about the allegation.

In late 2015 TUSLA applied to the courts for a full care order for ‘Mark’. 

As part of the court process ‘Susan’ was required to produce two psychiatric assessment reports carried out on the state of her mental health. ‘Susan’ agreed.

But what ‘Susan’ didn’t understand was that she would be personally billed by her doctor for the reports – €500 for the first report and €300 for the second one

On one occasion she was forced to take out a loan from her credit union to cover the cost.

In an initial statement to RTÉ, TUSLA said it “…does not require individuals to undertake psychiatric assessments at their own expense…”

However when we went back and asked TUSLA to explain why ‘Susan’ ended up paying  her doctors bill, a spokesperson said they “…cannot comment on individual cases…”

Last year the court ruled that ‘Mark’ will stay in care until the age of 18.

‘Mark’ continues to live with the same foster family to the present day – along with the older child alleged to have previously abused him.

      Don’t know Jake. There is nothing whatever dishonourable about open and honest adoption. However, this is not the way adoption has been treated in this country. Does this go some way to answering your question?

      Adoption can only happen with the consent of the parent(s).

      If ‘Susan’ thought that she may be able to take care of ‘Mark’ at some later date she may have refused to allow adoption to allow her raise hew son.

    Does the HSE and Tusla actively headhunt for work-shy, child-hating bastards or is it just lucky to be so well staffed by them?

    I’m kind of sick of commenting on stuff like this, it;s always the same, it never changes, every generation has a proportion of its kids’ safety sacrificed by well paid superannuated sadists. Lucky for them nothing in Ireland is a crime and no one goes to jail and pensions are more secure than any child in state care could ever hope to be.

      ah, perhaps it is a failure of selection criteria and vetting and testing of applicants. Hard and bitter experience (of unfortunate children, not me) should teach us to be ‘suspicious’ at least, of those whose desire is to “work with children”. That’s number 1. However, in my own profession it has been my misfortune to have to interact with many and varied organs of the State. The experience has not necessarily been a happy one. A reasonable person might conclude that the State – for humanitarian reasons, of course – employs (‘well got’) people who would otherwise be unemployable in any normal organisation. Hence the chaos we face.

    What the fupp is wrong with country. But these organisations are staffed full of people who just want cushy jobs. I can give u an example of my sis in law, I won’t name the exact place but they deal with homelessness, families in hotels mainly. When she took the job, only a few weeks ago, she assumed it would be like her old job (non government funded) as in, when you finish those cases come back and get more. Expect now it’s a government funded “agency” she works for she only has to do a certain amount of case assessments each week. And I kid you not, if by Wednesday she finishes her quota, that’s her finished till monday. Wtf, how can any where run effectively like that?

            Yikes – you’re really going into one there! I was involved in the second wave of feminism. It ultimately failed, thus, the third wave. In a responsible State, one would think that kids would be safe in their family environment. When they aren’t safe – it”s a matter for the State. Child abuse appears to be rife in Ireland, going back decades, The Catholic Church and their representatives certainly don’t help. Foster care clearly isn’t working for vulnerable types – but why should that be the case?

            Mental health, and in particular men’s mental health, while relevant, is not what this post is drawing attention to. You are the one who did that.

            You’re quite right to draw attention to the issue, because it’s a huge failure to men, and dismissive of men’s mental health, in general. But this may not have been the most effective platform for what you’re trying to achieve.

            Why wait until he gets out of the situation to do something about it when it is known now that he’ll have a wall put up because he’s a boy and not a girl when we know now he’ll face that limited or potentially denied access.
            You don’t call the doctor on your death bed, you get to the doctor before it gets that bad. This is no different, especially when it is clear that an ideology is actively building that restriction to access. Its disgusting what third wave feminism does in the guise of what they call “equality”. Its sick.

      Actually guys, he has a point with that report. It isn’t a surprise that ideology from a single NGO has influenced policy, but it is sad when it is so brazen and when there are lives at risk (i.e. male suicide). The article isn’t exactly unbiased, but that doesn’t make it incorrect.

      However, time and a place clampers. You’re turning an utter diabolical situation into a specific agenda. It’d be fine if we knew that sexism was at play here. There have been 22 inquires into the state’s failure to protect children. What we see is the same pattern irregardless of gender: the abusers are protected and the child ignored.

      This is why you’re ignored, you consistently twist a news story to push an agenda. It’s worse when it is capitalising on something like this.

      You’re right. That report is a clear statement from governments that they do not care about evidence or equality. Only the appearance of equality. But it has nothing to do with this story or the circumstances.

      If there’s one thing you can say, it’s that the state’s incompetence and gross negligence in relation to child protection, child welfare and child abuse has been equally applied to all genders.

        It is directly related to the welfare of the young boy who will be pushed down the queue of ‘need’ assessed and replaced with ‘gender’ assessed and so it is very relevant to this story.

        I am pro ‘needs’ based and anti ideology based policy. it’s that simple.

      Read back the thread and look what you’ve done to it and maybe you’ll realise you look like a frothing madman reeling off learnt phrases, shoehorning a pet obsession into a really serious, sad story of an abandoned child that bears not even a tangential relationship to whatever the fupp you’re copying and pasting from your radicalised brain.

        When that child needs psychological help, he’ll be put at the back of the queue because of his gender, because of a bullpoo ideology. the point is pertinent to his recovery when he gets out.

    If boys are treated as not as ‘in need’ as girls, that’s diabolical, Clampers, really is. I don’t know enough about it to comment apart from that it seems glaringly clear that a some foster carers are only in it for the money. They no doubt qualified as foster carers without thorough enough checks and have little, if any, regard for the children. They should be prosecuted for not reporting the little boys complaint and barred from fostering. How an adult can turn a deaf ear to sexual abuse claims is heinous
