Kenmare District Court, County Kerry.

The two men, of Sandymount, Kilgarvan, are sons of Independent Kerry TD Michael Healy-Rae. They were convicted along with a third man, Malachy Scannell, of Inchinacoosh, Kilgarvan, of assaulting an English visitor to Kenmare during which he was punched in the face half a dozen times.
Mr Scannell was given two sentences of six months in jail, which were also suspended.
Judge David Waters said there was no doubt that all three would have been going to jail, were it not for the fact that they had no previous convictions.

A suspended sentence means you get away with it. The local, Kerry based, judge decided to pretty much vacate the verdict and the Healy Rae boys get no punishment.
Neither of those things are true. People rarely go to jail for most first offences. Anyone who assaults someone like that is a toe rag though.
The non Healy Rae got banged up.

I would have them in chain gang picking up rubbish but, as justin says, it is almost unheard of for someone to get a custodial sentence on a first offence, except for the most serious of cases.
If you want to be horrified by our lenient legal system simply attend any district court and see the majority of skangers get suspended sentences any day of the week.
My mistake. They all got away with it.

Can any of us with no previous convictions punch each of them in the face then ? for a suspended sentence? “This is our town..” The old man obviously makes comments like this to his kids behind closed doors. As do most politicians I’m sure.

Do you have to be Garda vetted to be a parliamentary assistant?
Okay so they’re applauded for having no previous convictions but they have one now, right? Are their criminal records lifelong and must they declare it when applying for a job, a mortgage, or (importantly) running for public office?
If they’re asked by an employer to be Garda vetted the employer will be informed. As for public office, everyone in Kerry knows.
And I have no doubt that they will top the poll when their time comes, too…

Garda vetting is normally for occupations – paid or voluntary – which involve particular human skills and responsibilities where abuse can go undetected, such as childminding or youth leadership. I was referring to the request by a growing number of employers on the applicant’s declaration of no convictions. I’m not sure, but don’t insurance companies and financial institutions ask this too?
One county may know their candidate has a conviction but votes them in anyway – but surely there should be a character assessment elsewhere in the process? What I’m really saying is, it’s bad enough that the Healey-Raes may see their behaviour and conviction as not impeding their political career ambitions (and chances) but it’s worse if the political system and electorate sees this also. ‘Ah shure he was only young and drunk’ they’ll probably say.
