The key provision in the Act is Section 12 which states that local authorities have no entitlement to charge for domestic water. This represents local authority defeat in the ‘water charges battles’ of 1994-1997 which broke out after some local authorities decide to charge for domestic water. To compensate for removing the entitlement to charge, the Act provides that in future all motor tax payments are to be paid to local authorities and go into a local authority fund (the Local Government (Equalisation) Fund) ring fenced for local government purposes and used primarily to finance regional and local roads and the general purpose needs of local authorities. The Act also provides for the supplementation of the fund by an exchequer contribution.

I have waved this puppy around in the last few weeks and no one can give me a definitive answer. This act is referred to in the Water Service Act 2013 http://www.irishstatutebook.ie/pdf/2013/en.act.2013.0006.pdf so by this I am concluding that the Local Government (Financial Provisions) Act 1997 is still a valid act and therefore a percentage of money that I pay through motor tax goes towards the supply of water. As I am already paying for my water, I have no intention of signing up to Irish Water.
If we have a new Water tax and the Water Service Act 2013 supersedes this act, then why hasn’t there been a reduction in motor tax in the last budget? This is my interpretation as a non-legal type citizen.

As a non-legal person myself… does that mean if I don’t drive I haven’t ever paid for water?
because the amount you pay “towards the supply of water” doesn’t fully cover the cost of providing you with that water.

I still don’t think it is a double tax…. we haven’t really paid any ‘direct’ tax for water since rates were abolished in 1977, that’s a direct fact.

No, it’s still not a double tax.
The money was not specifically ringfenced to pay for water – it went into central taxation along with every other tax. Central taxation no longer pays for your water. There is no a charge that only pays for water (and does not go into central taxation).

The presumption that it would follow that motor tax should fall is also incorrect. If the money raised by the increase in motor tax had been ring fenced solely for water, you’d have an argument but because it’s a tax going straight into general funds there isn’t (aside: motor tax as a whole probably should be itself ring fenced for roads and the like but isn’t). This is the usual problem when government raise money by increase a tax – they get addicted to the money and keep taking it but change the reason over time (USC is another example of this).
As I mention in another comment below, general taxation is no longer paying for your water directly (the tax credits and social welfare allowances aside) so you are no longer paying for water that way. It’s a separate (and water only) charge.
Remember though that income tax and USC have both fallen in 2015 so there has been a drop in general taxation for workers.

The original intent was that water services would be covered along with roads etc.
Now the junky finds he needs more junk to get high.
And were expected to pick up the tab.
