The first half of ‘Whistleblower’, a documentary by Katie Hannon (top right) about Maurice McCabe’s fight against Gardai malfeasance, was broadcast on RTÉ One – featuring interviews with Sgt McCabe (top centre) and Lorraine McCabe (top left) and will conclude tonight at 9.35pm.

Further to a report in The Sunday Times by John Mooney last weekend…

In which Mr Mooney reported that the State is paying for the legal representation of former Garda Commissioner Martin Callinan in an action taken against him by Maurice McCabe, following an agreement finalised in mid-July

After the Disclosures Tribunal heard evidence from Fianna Fail TD John McGuinness, Comptroller and Auditor General Seamus McCarthy, RTE journalist Philip Boucher Hayes and Fine Gael TD John Deasy that Mr Callinan spoke derogatorily to them about the now retired sergeant…

A petition has been set up on Uplift calling for the State not to do so.

The petition sets out the following reasons for why the State shouldn’t cover Mr Callinan’s legal costs:

1. The most senior Garda in the country knowingly and deliberately smeared a serving Garda who raised the shortcomings in performance of other Gardai.

2. The State already funded the Tribunal to establish the facts and the facts have vindicated Garda McCabe.

3. For the State to then indemnify the guilty party is further persecuting the McCabe’s and also means there is no consequence for the guilty party.

4. The Minister for Justice should review the former commissioners contract of employment to see what sanctions were possible for breach of contact for bringing the force into disrepute. If there is such a provision the State should then seek to review his retirement and pension arrangements and if necessary take action to recover costs borne by the State because of his scurrilous actions.

5. This sets a dangerous precedent, where employees of the State can ruin peoples lives with absolutely no consequence for their actions.

At the Disclosures Tribunal Judge Peter Charleton accepted Mr McGuinness’s evidence that Mr Callinan told him Sgt McCabe “fiddles with kids” and referred to both Sgt McCabe and former Garda John Wilson as “fucking headbangers” in January 2014.

He accepted that Mr Callinan told Mr McGuinness, during a meeting in a car park of Bewley’s Hotel on the Naas Road, Dublin, on Friday, January 24, 2014, that Sgt McCabe sexually abused his children and nieces.

And he accepted that Mr Callinan led him to believe there was a live investigation of some kind, causing Mr McGuinness to believe that charges against Sgt McCabe were imminent.

Judge Charleton accepted that Mr Callinan told Fine Gael TD John Deasy, on the way to a Public Accounts Committee meeting on Thursday, January 23, 2014, that Sgt McCabe was not to be believed or trusted with anything.

He also accepted the evidence of the Comptroller and Auditor General Seamus McCarthy – whose report into the quashing of penalty points was being discussed at that PAC meeting – that Mr Callinan told him Sgt McCabe was not to be trusted, that he had questions to answer, and that there were live allegations of sexual offences against him.

And he accepted that Mr Callinan told Mr Boucher-Hayes, before a broadcast of RTE’s Crimecall in December 2013, that Sgt McCabe was a “troubled individual” with a “lot of psychological issues and psychiatric issues”.

    Show us the unredacted photos of the off-duty Gardai posing with “Maurice the Rat” and their obscene sexual gestures, show us their faces. A decade ago, they knew they could act with impunity. Let’s see the faces of these fine pillars of the community and see what sort of response they get in 2018. Wonder are any of them in senior Garda roles. Why is Katie protecting their privacy now.

      Presumably legal reasons. It’s not like anything has changed. They’d happily spend vast fortunes of tax payers money hiding behind legal protection and then head off in to the sunset on a lovely lovely pension. Not a thing has changed though. Don’t think for one minute that the same thing wouldn’t happen again in the name of protectionism. It’s probably going on as we speak in fact. Total and utter law to themselves. Added to that, after seeing what happened McCabe, what guard in their right mind would even attempt to go down that road. *Sighs*

      By the that man is an absolute hero but at what personal cost! There should be a statue of him erected.

    Once again official Ireland has managed to bypass state/police corruption. Everybody knows the truth but, in our corrupt banana republic, justice and truth are funnelled down the bogus tribunal path that is specifically designed to protect the powerful and the corrupt. The Disclosure Tribunal is no different from all the other whitewash tribunals, it did its job in protecting those with power and influence. Now we have the traditional RTE [Government broadcaster] documentary crying crocodile tears but still no justice, no facing up to the rampant state corruption that has destroyed so many lives.

      Katie Hannon of RTE made this doc, and RTE are airing it. OK I know it’s great craic knocking RTE, but doesn’t it seem like on this occasion RTE is on the side of the goodies here?

        No, because the elephant in the room is being ignored – State/police corruption. The guilty will walk away with big pensions and Katie Hannon/RTE will receive an award – meanwhile, the next scandal is breaking….and on it goes

          Look, if I had any say in the matter I would boot Ray D’Arcy and Ryan Tubridy to the moon and divide the savings between a token license fee rebate and more investigative documentaries. But how in your opinion could this doc and have been created and aired in such a way as to make you ‘happy’? What is your beef with RTE here?

            Looking forward to pt2 tonight? Doubtless, you’ll see Katie Hannon round at Martin Callinan’s house, rapping on the front door and jamming her foot in it when Callinan answers. And then, there’ll be footage of Katie chasing Martin down the street, shouting questions like “why did you smear Sgt McCabe”, “why did you select child sexual abuse for the smear”, “why was your evidence not accepted by the Charleton Tribunal”, “did you not tell the truth under oath”, “do you want to apologise to Sgt McCabe and his family”, “will you be contributing to the cost of the Tribunal, which was established to determine if you had smeared Sgt McCabe”

            Of course you won’t. Maybe that’s the point being made by Anthony.

            You seriously think Callinan is painted in a positive light here???

            So you want the Jerry Springer Show. Fair enough, but IMHO to me a dignified presentation of the facts is a far more powerful indictment. Especially given the gutter tactics used by McCabe’s enemies to smear him.

    My God, I think what has horrified me is the vast majority of us have ethics, give standards to our toddlers.
    Gutter standards in Justice Dept , disgraceful and insulting to every citizen in this country.

    It was a great programme by RTE and Katie Hannon. It was the first time I saw the actual note that was circulated around the Cavan-Monaghan division about Sgt McCabe’s concerns. It was headlined “Maurice McCabe” and referred to Maurice’s concerns in its body, saying an investigation had fully vindicated the standards of policing; that wasn’t even correct as an investigation had upheld several concerns. Imagine that though, you raise genuine concerns and a senior Garda sends that sort of note around to every one of your colleagues.We’d heard about the note before, but to see it typed up in black and white. Jesus.
    “Mr McDowell pointed to a 2011 letter from Chief Supt Colm Rooney circulated within the Cavan/Monaghan Garda division, which claimed an internal inquiry into concerns raised by Sgt McCabe had vindicated standards and professionalism in the Bailieborough Garda district. Last February, Chief Supt Rooney, now retired, apologised and said he now believed the views expressed in the circular were inappropriate.
    Mr McDowell said as a result of the notice being circulated Sgt McCabe “was left vilified in this way as a crank”.”

    Martin Callinhan really is one vile, sick, disturbed individual.

    There will be murder if the state covers his costs.

    I’m wondering why he decided kiddy fiddling would be made up against McCabe. I mean why that? Makes you wonder.

    Another thing, why has there been no consequences for Ms. D & her stinking father at all? Nothing.. Privacy protected to boot.

    All these fupping muppets in the places McCabe worked who shunned him can hang their heads in shame.
    As well as that shower of idiot Gardai in the pub with the plastic rat. Did they all get the bus home on the night in question? The drink driving laws don’t seem to apply to them at all. All fun and games with yer plastic rat wasn’t it.. you’d get better behaviour from 5 year olds.

    All this smearing only works because people don’t want to think for themselves. Why would you base the opinion of anyone on what someone else tells you about them? I don’t get it? Is it laziness? Group think? Do people never think about the person’s agenda? Like maybe just maybe there’s an agenda here? Maybe I don’t have all the information? No?


    Maybe the education entry level requirements need to be upped to get into the Gardai? The culture still needs to be tackled IMO as well as having proper oversight.

      Fully agree.

      I really do not understand how the state can defend Moustache Pete if McCabe goes after him in a private capacity.

      Also, have they, sorry, WE picked up the cost of Angela Kerins legal action yet or is that being strung out so long people will just forget?

      This is beyond disgraceful, but look at idiots like Flanagan, Fitzgerald and Spin City Leo and its no real surprise.

      Idiots, shysters and gombeens, its the axis of drivel.. Powerful, life ruining drivel though.

      Its more likely the guards will have a party celebrating his departure so they can get back to their corruption.
