      I don’t think he did it but my mind was changing episode by episode and sometimes several times in an episode.

      It’s not what you believe, it’s what you can prove. Now my gut tells me he’s got something going on, he’s a bit too clever. But so what.
      There’s a very good yoke on bbc iplayer at moment about forensics Real CSI – you can see the lengths & burden of proof required in the modern world to get a serious offence to trial. Forensics is key, everything else is soft circumstantial & witness guff.

      This current trial though…it’s a bit weird to me. I’m not sure exactly what it’s supposed to do one way or the other except maybe build a monument to the poor woman. Mechanically I can’t see how this can work out.

      I’m not convinced by his innocence. Whatever the truth, which we’re unlikely to ever know, it was damn foolish to state to some locals as he did on a number of occasions that he murdered STdP. Oddly, for a time it seemed that he reveled in the notoriety of the case.

      The botched investigation didn’t help either.

    If I was in Ian Baileys situation – I would insist on polygraphs tests to prove my innocence. I would offer to be questioned under caution by experienced officers , experts in homicide , chosen by the French authorities. I wouldn’t mind even being hypnotized. In fact I would insist on all of above to prove my innocence.

    So (1) No-deal Brexit (2) Withdrawal Deal and (3) Second vote

    As we approach the third anniversary of Brexit, that’s where we are.

      Mind you, Corbyn backing another vote is a major change. In a way Farage has done the Remain camp a favour because if it is a stark choice between no deal and Remain, support to stay will continue to grow.

    The Chinese? Was this another deal facilitated by Enda Kenny’s Ireland China Foundation? Busy man is ‘r Enda these days, though obviously not in the Dail where he’s paid €90k a year to miss practically every Dail session.

    Clare Daly standing up for democracy and her rights in the RDS didn’t make it into the press as it all blew up after 10pm last night.

    FF don’t want Lynn Boylan’s votes transferred (because that would likely put Clare #3 and Barry Andrews at #4)

    As #3 Clare would be going to Europe now, while at #4 Barry would have to wait until the EU leaves.

    It seems practice would be for Lynn’s votes not to be transferred because we already know who the #1,#2,#3 and #4 are. But in this case, where #3 goes to Europe now and #4 doesn’t, it’s significant who gets which position. Legally, it seems Lynn’s votes should be transferred. And it seems Clare might have to go down to the High Court to force the returning officer to follow the law and not practice.

      Yes, there are statistics, statistics and statistically discombobulating statistics. Until candidates reach the quota the normal counting procedure is to eliminate the lowest candidate and distribute her preferences.

        The votes of the last person eliminated are generally not distributed as the remaining candidates are deemed to be elected. This is an unusual case as the Brits are occupying seats that belong to someone else and either Andrews or Daly will be left on the bench until they finally leave. Distribution makes sense in this case but sense and law aren’t always remotely related.

      Personally, I think that all the votes should be counted and Lynn’s distributed.

        Turns out it was decided back in March through the European Parliament Elections (Amendment) Act 2019 and Andrews gets the seat.

            I’m going to disagree with you there as section 9(4) sates:
            “(4) This Act shall come into operation on such day or days as the Minister for Housing, Planning and Local Government may appoint by order or orders either generally or with reference to any particular purpose or provision and different days may be so appointed for different purposes or different provisions.”
            So nothing to do with Sasamach.

            This act covers this election.

            Nothing to do with the UK leaving the EU and everything to do with the ministerial order being made under S. 9(4).

            The Statute Book online says no such order has been made, but I would have to give a health warning that the online statue book isn’t always completely up to date with amendments and commencements.

            Is there any (good) reason that different Statutory Instruments would be used for different commencement dates for this particular act? One that is time-sensitive (as in the act section relates only to the 2019 EU elections) ?

            Oops – silly question.

            I presume that the second SI was only signed late in the day because Brexit still hadn’t happened. If the UK had left in April/early May, then those sections of the Act would not have been needed .

        They brought in an amendment this year to deal with this issue (which would seem to support Andrew’s case of NOT distributing Boylan’s votes, although there are varying opinions on this), but there still seems to be a smell of “it’ll end up in court” about it all given the weird situation. In theory, this goes further – if this was only a three seater (ie if the UK doesn’t end up leaving at all), the quotas would have changed (higher) and various surpluses wouldn’t have been transferred on previous counts (and #1 and #2 seats may not have been elected yet). What if that had led (in an unusual situation which is unlikely to occur here) the #3 and #4 seats overtaking the #2 seat after the Boylan distribution? It’s all a bit of a mess.

    Yesterday’s court proceedings, where the DPP is after journalist Nicola Anderson and editor Fionnan Sheehan for an article in the Indo last November which allegedly led to the collapse of a rape trial, adjourned to the end of June.

    I wonder if the DPP will get around to the Mail for its Lucan child murder trial reporting after the judge in the actual criminal trial yesterday said he was going to reduce the daily court hours because the material being digested by the jury is so distressing.

    No reporting at all about either DPP action in today’s press.

      First you complain about a newspaper alledgedly interfering with a trial by reporting on it.

      Than you go on to give out about other newspapers NOT doing the same thing.

    Will Maria Bailey be kicked out of FG after her dodgy compo claim? No, FG only has 49 TDs, 48 after Frances goes to Europe, it is already in a very precarious position and, with Frances gone, one less than a majority even with the support of Lowry and several Indies.

    With Maria gone, the government would surely collapse.

            Brilliant martco.
            In future, insurance policies will include a Bailey clause which will stipulate how your insurance company will deal with taking-the-piss claims against you by a supposedly injured party. There might also be a clause cautioning you against indulging in such conduct.

      Ok, according to the European Parliament Elections (Amendment) Act 2019, section 6.h.iii
      “where two or more candidates are deemed to be elected at the end of a count, the candidate with the greater number of votes credited at the end of that count shall be deemed to be elected before a candidate with a lower number of votes credited at the end of that count.”

      That means Andrews is in the right and Boylan’s votes don’t need distribution.

            …the UK EU election results confirm what Boris Johnston has said – a no deal brexit is closest to what the UK electorate voted for. Whatever about remain, there is a parliamentry majority against a no deal exit and so it won’t happen…to deny a count of Lynn Boylan surplus is to import a bit of the EU chaos here…

            No, if they count like it’s a 3 seater then weneed a full recount with a different quota.

            The act states that it be counted as a 4 seater and that the 4th seat is not taken up until the UK leaves the EU. It was under this understanding that the election was run.

            The UK EU election results where the majority voted for a Remain party confirm nothing the tea boy has said. Go bang your no deal drum somewhere else instead of trying to shoehorn it into a situation it has nothing to do with.

            The Brexit party picked up the most seats of any individual party but the combined Remain seats outnumber the combined Brexit seats. In fact the number of Leave seats overall dropped by about 10.

            The referendum result has not been ignored and you repeatedly saying it won’t make it so.
