Texas Attorney General Ken Paxton is asking the US Supreme Court to instruct legislatures in four states to throw out what he calls “tainted” results and select their own slate of presidential electors.

Via Newsweek:

The Republican-controlled legislatures in Georgia, Michigan, Pennsylvania and Wisconsin would then be free to choose electors who could vote for Trump when the Electoral College meets on December 13.

At least 17 states that voted for Trump have signed a brief supporting the Texas lawsuit, which claims that the four states in question didn’t follow election laws correctly in administering the 2020 election. Trump has also filed a motion to intervene in the case.

The U.S. Constitution permits states to decide their own laws on running elections and a variety of legal experts have harshly criticized the Texas lawsuit, with some arguing the Supreme Court won’t even hear the case because the state doesn’t have standing to sue its sister states in this way.

    This is just blatant, right? They want these electors to ignore the voters and install Trump as head of state. This is a straight-up bid for autocracy, on its face. This is a repudiation of democracy.

        That’s the official line, yes. Disenfranchise the voters in those states because we don’t like the result. Paxton is suing the 4 states on the grounds that they made election procedure changes in response to the pandemic. Guess what other state did that? That’s right, Texas.

        Of course the real driver here is Ken Paxton has been indicted and needs a pardon from Trump.

        As an aside, the Alamo was a victory for Mexico over the Republic of Texas.

          Trump is a dictator for following the law; and insisting on the constitution he has sworn to defend.

          While those state level executives who broke the law and stepped outside state and federal constitutional parameters in order to facilitate millions of illegal votes they’re the real heroes here.

            I’d imagine the level of popcorn would depend on the level of koolaid and you’ve clearly hit your limit on that.

            All the arguments in the Texas lawsuit have already been dismissed at every other court level. The Electoral college votes Monday and that’ll be that.

            You really need to read beyond headlines Fanacht.

            The Texas suit is an amalgamation of all the allegations that were rejected at every level below Supreme Court. Knowing this, and knowing they’d be rejected at those levels again, Paxton went straight to the Supreme Court. It’s a big flashy show for the idiots, and the idiots are loving it, but it’s all an illusion.

            For a start, it’s asking SCOTUS to delay the electoral vote for Georgia, Pennslvania, Michigan and Wisconsin. Doing so would be unconstitutional as Article II of the US Constitution states “The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States”.

            Congress met and determined the day to be Monday, December 14th. SCOTUS has no authority to change that or to delay for some Electors as it clearly states “which Day shall be the same throughout the United States”.

            “The terms of the President and the Vice President shall end at noon on the 20th day of January…”

            That doesn’t change the simple truth that for SCOTUS to delay the electoral vote would be unconstitutional and, therefore, won’t be happening. Vote takes place Monday and Biden will be voted in as president.

            There is no date mentioned in the constitution for the Electoral College vote.

            The Texas case simply asks the SC to validate the selection of the Electors by the state legislature as is originally set out in the Constitution and to dismiss/restrain/invalidate any selection resulting from last minute rule changes imposed on those states’ presidential plebiscites by out of control state executives and not ratified by the state legislature.

            40 days til the end of Trump’s first term and the start of his second term.

            Look at you getting excited without knowing the full facts.

            Seven Republican members of Congress from Pennsylvania joined the suit. That’s not even all the Republican members of Congress in Pennsylvania and some of the seven were already involved in cases brought to delay the result in Pennsylvania. Those cases were all rejected.

            While them signing on may be exciting for you it won’t make one iota of difference to the outcome.

      Think of the USA a bit l like the EU. There are federal laws and state/country laws.

      When we elect MEPs in Ireland we use PR-STV; in Germany they use a party list.

      It would be like Ireland saying that the German MEPs weren’t elected fairly.

    3,265 covid related fatalities yesterday according to the Worldometers, but this is what the Republicans are focusing all of their attention on at the moment.

      For context. In 2019 the US had a total of 2,839,205 deaths; this is equivalent to 7,778 deaths per day (if each day is the same). For December 2019 there were 8,258 per day.

      If (and this is totally likely) there are no excess deaths, then 40% of yesterday’s 8,258 deaths were Covid related.

      If all of these were excess deaths, then 28% of yesterdays 11,523 deaths were Covid related.

      The actual percentage lies somewhere between 28% and 40%

            you can get 2019/2020 flu numbers (summary below) or 2020/2021 flu numbers (next year)

            COVID-19 is caused by a coronavirus and the flu is caused by an influenza virus. These are two similar but distinct types of viruses that can be easily differentiated in a lab. But new data from the CDC may point to the flu being misdiagnosed as COVID-19, resulting in higher coronavirus numbers but much lower flu numbers. In fact, there has been a 95% decrease in flu cases during current weeks 40-41.

            This time last year, there were 1251 flu cases reported to the CDC during weeks 40-41. This is about average. But in 2020, we’re seeing a record low number of 61 total flu cases reported in the same time period. It doesn’t take a medical degree to come to the logical conclusion that the flu didn’t suddenly disappear but that it’s simply being misdiagnosed as COVID-19.

      Especially if not all the voters – throughout all the States, are not qualified equally to vote under all the same terms and qualifying conditions

      At least here to get on the local electoral register is the same in every Constituency
