So is BS gonna report on that now? Bring readers up to date on the unanimous decision of 7 judges of the Australian High Court to throw out Pell’s conviction, quashing it on the basis that it was unsafe given the significant evidence, ignored by the jury and prosecution that he was not guilty and that the alleged abuse couldn’t have taken place? The Guardian covered that extensively too. Maybe combine the stories. Since BS kept us up to date on Pell’s charging, conviction (and then again when reporting restrictions were lifted) I’m sure you’ll be only too happy now to report on the conclusion of the case, his release and, perhaps, the serious issues raised by the shambles of a case.

The jury system is sensible, but not failsafe. A robust appeal system is vital for a healthy judicial system. You’re not proposing to do away with appeal courts, are you?

“significant evidence that he was not guilty and the abuse couldnt have taken place” says newsjustin

“the evidence did not establish guilt to the requisite standard of proof” says the actual case report

it didnt at all conclude that he was innocent – simply that there wasnt quite enough there to prove definitively that he was guilty

Innocence isn’t established, nor does it need to be, in a court of law. In Australia (and Ireland) everyone is presumed innocent until proven guilty.

Read the decision fully and you will see that the High Court found the jury’s decision to be unsafe due to their failure to consider the evidence presented to them that the alleged abuse did not occurs, and in fact, that it could not have occurred. Especially given the prosecution’s decision not to challenge that evidence in any meaningful way.
