Talk about missing the point ! She, the judge, is talking about witness reliability ffs. Not the committing of the crime, but the fact that evidence is one word against another persons. And drunk people will never make reliable witnesses… that’s what the judge said.

A PERSON who has been raped at a time when they were drunk POTENTIALLY does not make a good witness and the chance for a conviction can be lost.
However, if they are not raped, no need for a court case, no need for a conviction.
The lesson should be ‘Rapists – Don’t rape’ rather than ‘Women – Adjust your behavior’
