Tánaiste Leo Varadkar says a “corona pass” could mean avoiding another lockdown if there’s a fourth wave of Covid.
He said:
“We can use those three weeks to develop plans for a corona pass, which let’s not forget may pave the way for the reopening of not just indoor hospitality but indoor sports and live events [as well] even if there is a Delta wave.
“That’s one of the things that maybe isn’t fully understood about the decision and advice from yesterday. Option one is to not reopen indoors until we have herd immunity – and who really knows when that will be. We’d hope it would be September, but maybe not.
“Now we have this option to use a corona pass… and potentially never having to lock down again.”

“We had initial advice yesterday from the Attorney General who believes this is lawful.
“We will obviously pass certain laws to do it, but that it wouldn’t be unconstitutional, but that was an initial advice, he wants to consider it again.
“I have to say, I am disappointed with the approach of Labour and the Social Democrats in particular.
“Up until now, they’ve always said that we should take public health advice and follow the advice of Nphet (National Public Health Emergency Team).”

That aside, it would be political suicide for any corona pass to just be simply for the vaccinated. There must be a way, like in Denmark, for unvaccinated younger people to access pubs and restaurants, via rapid testing otherwise there will be trouble.

As a medical insurance premium holder, and former pupil of a voluntary school (what proles refer to as private), I’d be fully supportive of contributing some of my own money to a Covid top-up card that will allow us front of the queue walk-ins and preferential bookings for indoor dining.
Anyone on a free Covid card could then have queues for walk-ins and a waiting list for a small bloc of reservations at the restaurants. You could have a takeaway hatch then for Trypanophobic science-deniers to get a burger and chips, and a pint in a 7-11 Big Gulp cup.
I got my jab today – I’ll be eating squab indoors in a month and you’ll be sitting on O’Connell bridge with your scruffy pals burning masks and demanding more PUP

These statements aren’t conflicting.
Both EU law and the Irish Constitution are superior to Irish national law. This means that the government cannot pass national laws that contradict EU laws/Constitution.
Before any legislation is made you must first see if it is lawful. If it is lawful, you can then proceed to make it the law.
It’s not the law currently is it? So it can’t be believed to be lawful, as it’s not recognized or permitted by law. It’s not legitimate – it’s not recognized by the law. So, he can’t believe it to be legitimate, if it’s not law.

You seem to be confusing “lawful” and “legal”. Perhaps this will help:
The terms lawful and legal differ in that the former contemplates the substance of law, whereas the latter alludes to the form of law. A lawful act is authorized, sanctioned, or not forbidden by law. A legal act is performed in accordance with the forms and usages of law, or in a technical manner.
The important bit is ” A lawful act is […] not forbidden by law.”
If there is noting in EU legislation, or the Constitution (or Irish law) that forbid the use of “a corona pass” then it is lawful.
If Irish legislation is passed that has rules for “a corona pass” then the new “laws” makes it become “legal”.
