Emma Nic Mathúna, the mother of five caught up in the CervicalCheck scandal, addresses the Standing 4 Women rally with Sinn Féin President Mary Lou McDonald in attendance.

Emma remains involved in court action despite assurances by Taoiseach Leo Varadkar that the policy of obstructing victims would end.

    Mediation only works if both parties are reasonable and are willing to agree to a compromise.
    If either party has has a demand[1] that the other can’t, or won’t, agree to; then you end up in court.

    We don’t know why the mediation failed.

    [1] as examples. If HSE demanded a non disclosure agreement. If Emma demanded €100 million.

          I don’t blame her.

          Firstly, she now has limited time with her children and family – because of Cervical Check and the State.

          Secondly I would imagine she did that on the advice of her solicitors.

            Mildred. We don’t know for certain that that Cervical Check and the State are in any way responsible for her limited time.

            Yes, she has cancer.
            Yes, she had previous smear tests that should have given warning of the cancer.

            But we don’t know if the previous tests were misread or not. And we don’t know what lab they were tested in.

            Her solicitors don’t necessarily have her best interests at heart.

            @Cian. Cian, you have skin in the game. Isn’t it about time you came clean about it?

      I think it’s not a mediation issue. It’s an admitting of responsibility issue on the side of the HSE (who won’t accept it) and also, Quest are part of the case.
      Turns out that it’s only now came to light that there was an re- examination of tests in 2010, but up till now this was stated to have been 2013. Documented by Quest (i think as i caught bits and pieces on the news)
      The plaintiffs also want the hearing brought forward to June, rather than July.

          I don’t think the link you provided refers to ‘full’ responsibility. Quest are party to this too. But nice to see you dug a bit deeper than your initial post.
          To answer your question – if there was a failing in its own responsibility, then yes, I think the HSE should come out and admit it, and accept the responsibility for it.
