RTE reports:

“A 74-year-old woman who suffered life-long pain after a symphysiotomy was performed on her 12 days before the birth of her baby in 1963 has lost her High Court action. In what was viewed as a test case for others, the woman had sued for negligence, claiming there was no justification for the controversial procedure.”

“In her action the woman claimed she suffered life-long pain and could not bond with her baby and had a nervous breakdown.

The case was heard in the High Court over 15 days. In his judgment Mr Justice Kevin Cross found that ‘the practice of prophylactic symphysiotomy in 1963 was not a practice without justification’.”

Marie Farrell arriving at the High Court on Wednesday

Breakingnews.ie reports:

“Marie Farrell has said her teenage children were punished by gardaí after she admitted making false statements about Ian Bailey. The shopkeeper from Schull, Co Cork has told the High Court she met with the journalist 9 years ago to apologise for the claims she had made about him during the Sophie Toscan du Plantier murder investigation.

“Her garda statements place the 57-year-old on a bridge near the scene early on December 23, 1996. An emotional Marie Farrell said her 13-year-old son was followed around Schull by a garda who told him: ‘I’ll do you’.

UCD law lecturer Dr Liam Thornton tweets from the High Court as Judge Colm MacEochaidh delivers his judgement on the challenge taken by a family of two against the direct provision system.

The family of two, a mother and child, took the action, arguing that the direct provision system is unconstitutional.

The family have been in direct provision centres for more than four years. They claimed the system was unlawfully established, has no legal basis, continues to operate unlawfully, violating the Constitution and the European Convention on Human Rights. They also claimed the work ban and blanket ban on receiving social welfare payments breaches personal, family and equality rights under the Constitution.

It is also alleged the terms of reference for the report did not entitle Mr [Sean GuerinGuerin to reach the conclusions he had. There was failure to consider all the relevant documents, including documents from Mr Shatter and the Garda Siochana Ombudsman Commission. It is alleged Mr Guerin regarded himself as bound by a fixed eight-week time limit and he should have, but failed, to take the additional time necessary for the report. It is alleged “indecent haste” in concluding the report led to errors, including alleged failure to fully engage with the process.
