‘My partner Alicja I currently manage 3rd Place Coffee House in Dundalk.
The HSE has summonsed us to attend Dundalk District Court this Thursday 2nd December for failing to comply with a Compliance Notice served on 5th November. If the Compliance Order is granted the District Judge has the power to close our business down for 7 days.
Our customers health status is none of my business. Our café will never discriminate against our customers whatever the consequences. I intend to fight this all the way at the District Court and Higher Courts. It doesn’t matter how many politicians and journalist endorse it or how many businesses enforce it, it will still be discrimination. Wrong is wrong we all have a moral and ethical duty to stand up and do what is right.
We have set up a Go Fund Me to support our initial costs because in Ireland there are huge barriers to access to justice as there is no legal aid available for such test cases.’

We are two second year healthcare students training as a midwife and physiotherapist respectively, at Trinity College Dublin.
Healthcare students have been told by Trinity College that they cannot complete their clinical placement unless they provide proof of vaccination.
We are in the middle of our degrees. Now, we are being told that we must either prove that we have received a Covid-19 vaccine or risk bidding farewell to our career dreams, degrees, and all the hard work and savings already invested in them.
Clinical placement is a core part of our training, without which we cannot qualify as a midwife or physiotherapist.We were told by our university that all options would be explored in order to facilitate us going on placement, only to be later given an ultimatum: take the vaccine or risk losing your career.
We have offered to take part in routine testing for COVID-19, to wear additional PPE beyond what is required, and are open to whatever other non-pharmaceutical measures that could help mitigate any risk posed to patients but to no avail. Professor Martin Cormican, Clinical Lead of the HSE’s Antimicrobial Resistance and Infection Control team, has refused to meet with students to discuss measures to ensure that unvaccinated students can proceed with placement safely.
We intend to challenge these discriminatory and unjust policies at the High Court. This is the start of a journey. We wish to pave the way so that other students don’t have to endure the same inequality and maltreatment that we currently face.

IL Vicolo has raised almost 70k to fight the vaccine pass system in the courts.
The Italian restaurant has refused to ask for digital certs and has been inspected on several occasions by the HSE as a result.
They say:
‘We were served with a Compliance Notice on 20th August and brought to the District Court on numerous occasions. Our business was even shut for two days in September following an application by the HSE for an emergency cessation order. On 4th October the District Judge ruled that he did not have to address the issue of discrimination as the Compliance Notice issued by the HSE was worded in a way that meant that we did not have to prevent people from entering’

Oisin Collins, senior counsel for the restaurant, submitted in court that the EU Digital Covid Certificate regulation provided for a third category of testing. This omission was a clear breach of the regulation itself, European privacy law, the Constitution, the European Charter of Fundamental Rights and the EU Convention on Human Rights, he submitted, adding that his position on the issue of discrimination was unanswerable.
Stephen Moran, BL for the HSE, said the Irish Government were effectively “at large” in relation to how they wished to deal with the issue of re-opening pubs and restaurants at a domestic level, given the serious threat to public health and the rise in cases due to the Delta variant.
District Judge, John King, having heard detailed submissions on discrimination, decided that he did not have to rule on this issue as the compliance notice only went so far as to require records rather than prohibit people from entering.
“This is only the start of the push back against discriminatory laws. We received a letter from the HSE on October 14th that they intend to start inspecting our restaurant again as there has been further complaints of non-compliance,” the restaurant said.
“We intend to now challenge this discriminatory law to the Higher Court.”

Protesters gathered at Italian ports as the country braced for widespread disruption over new coronavirus requirements for workers.
Via Reuters:
Roughly 300 people blocked an entrance to the port of Genoa in the northwest, causing delays in what was feared to be the start of a day of blockades and demonstrations.
Hundreds also demonstrated at the port of Trieste, a major hub in the northeast, but regional chief Massimiliano Fedriga insisted “the port is working”.
From this morning, all workers must show a so-called Green Pass offering proof of vaccination, recent recovery from Covid-19 or a negative test — or face being declared absent without pay.
More than 86 per cent of Italians over the age of 12 have received at least one jab, thus automatically qualifying for the certification.
But up to three million workers are estimated to be unvaccinated — and most will only be able to work if they pay for their own tests either every 48 or 72 hours, depending on the type.
