Justice Michael White noted that Kevin Brazil (51) was first questioned about and admitted the abuse of this boy and another victim in 2002 but that inexplicably the then investigating garda did not send the file forward for prosecution.
The Central Criminal Court heard that in 2002 gardaí at Rathmines Garda station questioned Brazil and he made admissions.
This case and another case were investigated at that time but for some “inexplicable reason” no file was ever sent to the DPP, Superintendent Barry Walsh said.
Supt Walsh told Anne Rowland SC, prosecuting, that when he began investigating allegations from a third victim years later he discovered the Rathmines cases.
Mr Justice Michael White set a sentence of five years but reduced this by half and said he was taking the delay in prosecuting these offences into consideration and the fact that if the case had been prosecuted at the time Brazil would likely have served his sentence by now.

Patrick Gageby SC, defending, told the court that his client had been working in a large supermarket and he lost his job after his convictions were publicised last July.

People who are travelling to and from Covid-19 tests are being urged not to open their window if they are stopped at a garda checkpoint en route
Instead they should display their test appointment confirmation through the window.
Gardaí have said that at least five unmasked drivers who were on their way to a testing centre rolled down their windows to talk to gardaí at one checkpoint near Ashbourne in Co Meath yesterday.

The fourth day of protest outside Blanchardstown Garda Station over the killing of George Nkencho during stand-off at Manorfields Drive Dublin last week.
According to a report yesterday’s Sunday Times, officers claim that lethal force was their only option as they feared that the 27-year-old could stab a garda or take hostages if allowed into his family home.
Social media posts over the weekend falsely claimed Nkencho – who suffered from mental health issues – had a number of criminal convictions.
TD Brid Smith said:
“What saddens me is the number of decent people that believe the lies. George Nkencho, shot dead by Gardai last week, was a man with mental health issues, but NO CRIMINAL RECORD.”

Solicitors for Joanne Hayes – Patrick Mann and Bernadette Cronin- make a statement following the issue of an apology and compensation from the State to Ms Hayes for her treatment during the Kerry Babies case.
It was part of a case brought by Ms Hayes, her sister Kathleen and brothers Michael and Edmund following their arrest by the Gardai in May 1984.

Ms Hayes will receive €1.5 million, while her three siblings will each get €300,000.
Ms Hayes’ daughter, Ms McGuckin, who was a toddler at the time of the scandal, is to get a reported €100,000.
…As part of the settlement the family also secured declarations from the court that all findings or wrongdoing made against them by the Tribunal into the case were, that took place in late 1984- early 1985 were unfounded and incorrect.
The court also made a declaration that their questioning, arrest, charge and prosecution on dates between April and October 1984 were unfounded and in breach of their constitutional rights.

…Gardaí have used anti-spit hoods 118 times while policing during the coronavirus pandemic, according to a report from the Policing Authority.
The hoods, the use of which has been criticised by both the Authority and the Irish Council for Civil Liberties, have been used 100 times on males, 18 times on females and six times on children.
They have been deployed mainly in Dublin (on 51 occasions) and mostly during assaults and public order incidents – 54 times for public order offences and 34 times during an assault.
In 79 cases, the person appeared to be intoxicated, while in 16 cases the detainee was believed to have a mental health issue. In one case, the person was perceived to have “obvious signs of a learning disability“.
